What Is Habeas Corpus in Immigration Detention?

When someone is detained by immigration authorities, it can feel like there is no way out — especially after a bond denial or months in detention. However, federal law provides an important legal remedy called a habeas corpus petition.


A habeas corpus case is a federal lawsuit that asks a federal judge to review whether the government has legal authority to continue detaining someone. If the government has exceeded its detention authority, violated the Constitution, or is unlawfully keeping someone detained, a federal judge may order that person released from immigration detention.


When Can Someone Request Release Through Habeas Corpus?
